In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, February 11, 2019, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, February 25, 2019 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

 

The following described piece or parcel of land, situated in the Township of Deerfield, County of Portage and State of Ohio:

Being part of Lot 67 in said township and bounded and described as follows:

Beginning at a 1' square iron bolt found at the intersection of the Northeasterly corner of Lot 67 and centerline of C.H. 75, Bonner Road; thence South 89 degrees 07' 26' West along the Northerly line of Lot 67, a distance of 838.90 feet to a track spike set in the centerline of C.H. 71, Motown Road, which marks the true place of beginning for the following described parcel of land; thence South 34 degrees 47 40' West (passing over a 5/8' iron rod set at 36.93 feet) a distance of 219.08 feet to a 5/8' iron rod set; thence South 89 degrees 07' 26' West, a distance of 388.50 feet to a 5/8' iron rod set; thence North 00 degrees 52' 34' West (passing over a 5/8' iron rod set at 147.98 feet), a distance of 177.98 feet to a track spike set in the Northerly line of Lot 67 and centerline of C.H. 71; thence North 89 degrees 71' 26' East along the Northerly line of Lot 67 and centerline of C.H. 71, a distance of 516.25 feet to the true place of beginning, containing 1.848 acres of land, more or less (there being 0.348 acres more or less, in the riw of C.H. 71) as surveyed September 29, 1998, by Rob A. Szuch, Registered Professional Surveyor No. 7288.

Said Premises Located at 10416 Mottown Rd., Deerfield, OH 44411.

Said Premises Appraised at $45,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
