In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, October 15, 2018, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, October 29, 2018 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate is

 

Situated in the State of Ohio, County of Portage and the Township of Ravenna, and known as being part of Lot 43-South Division in said township and further known as being all of a parcel of land conveyed to Secretary of Housing and Urban Development, an Officer of the United State of America by Instrument No. 200600425 of the Portage County Recorder's Records, described as follows:

Beginning at a 3/4 inch iron bar found in a monument box at intersection of the Southerly line of Original Lot 43 - South Division, with the centerline of Lakewood Road, C.H. 151, a 60 foot public right of way, the true point of beginning; thence North 24 deg. 47 minutes 27 seconds East along the centerline of said Lakewood Road, a distance of 212.86 feet to a point witnessed by a 1 inch pipe found North 87 deg. 45 minutes 33 seconds East at a distance of 33.79 feet; thence North 87 deg. 45 minutes 33 seconds East, a distance of 322.66 feet to a 5/8 inch rebar with cap marked "5736" found on the Westerly line of land conveyed to Leslie L. Haney, Jr. and Denise R. Haney by Deed Volume 0109, Page 0331 of the Portage County Recorder's Records; thence South 14 deg. 38 minutes 35 seconds West along the Westerly line of said Haney, a distance of 193.89 feet to a 1 inch iron pipe found on the Southerly line of said Original Lot 43-South Division, also being the Northerly line of Hommon Avenue, T.H. 153, a 45 foot public right of way; thence South 87 deg. 07 minutes 00 seconds West along the Southerly line of said Original Lot 43, South Division, a distance of 363.11 feet to the point of beginning. The above described parcel of land contains an area of 64156.6 square feet of 1.473 acres, of which 0.146 acres lie in the public right of way of Lakewood Road, as surveyed under the direction of Timothy J. Briggs, PS 7495, Campbell & Associates, Inc., of Cuyahoga Falls, Ohio in April of 2006. Basis of bearings is South 87 deg. 07 minutes 00 seconds West, the Southerly line of said Original Lot 43 - South Division per Survey No. P-4509 by Wood dated 1976.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 5886 Lakewood Rd., Ravenna, OH 44266.

Said Premises Appraised at $115,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
