In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, May 7, 2018, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, May 21, 2018 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.


Situated in the Township of Nelson, County of Portage and State of Ohio and known as part of Lot 27 of said township and further bounded and described as follows:

Beginning at a 1/4" iron pin found at the centerline intersection of Parkman Road (C.H. 299) and Pierce Road (T.H. 292); thence South 18 degrees 45' 00" West, along said Parkman Road centerline, a distance of 780.41 feet to a point and a Southeast corner of lands conveyed to L. or J. Proctor by Volume 270, Page 732 of Portage County Official Records, said point being the principal point of beginning for the parcel herein described; thence South 18 degrees 45' 00" East, along said road centerline, a distance of 659.86 feet to a point and the Northeast corner of lands conveyed to G. or D. Berg by Volume 893, Page 1151 of Portage County Record of Deeds; thence North 85 degrees 31' 55" West, along said Berg's North line and passing over a capped "Daniel" 5/8" rebar found at 30.88 feet, a distance of 218.68 feet to a 5/8" iron pin found at a Southeast corner of said Proctor's lands; thence North 4 degrees 49' 00" East, along said Proctor's lands, a distance of 641.58 feet to a 5/8" capped rebar set; thence South 85 degrees 11' 00" East, along said Proctor's lands and passing over a 3/4" iron pin found at 347.55, a distance of 377.52 feet to the principal point of beginning and containing 4.3848 acres of land as surveyed in April 2006 by Clifford H. McGuire, Professional Surveyor No. 7770. Bearing are rotated to those used on survey plat N-75 the deed of record was 1155-541 to R. & I Tucker. All rebars placed are 5/8" x 30" with I.D. Cap, "C.H. McGuire, P.S. 7770". Be the same more or less, but subject to all legal highways. Subject to all easements and restrictions of record.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 10453 Windham Parkman Road, Garrettsville, OH 44231.

Said Premises Appraised at $45,000.00 and cannot be sold for less than two-thirds of that amount.


If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
