In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, February 5, 2018, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, February 26, 2018 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Brimfield to-wit:

 

Situated in Original Lot 40 Brimfield Township, County of Portage, State of Ohio:

Beginning at an iron pipe in the Southwest corner of Lot 18 Brimfield Lake Allotment First Addition recorded in Plat Book 11, Page 23, said point also being the true place of beginning for the property herein described; thence South 63 deg. 46' 19" West, a distance of 6.68' to a capped rebar set; thence along a curve to the left, having a delta of 42 deg. 32' 03" and a radius of 130.33' with a length of 96.75', and a chord bearing of South 42 deg. 30' 17" West, a chord distance of 94.55' to an iron pipe found; thence North 69 deg. 49' 29" West, a distance of 134.01' to an iron pipe found; thence North 58 deg. 39' 53" East, a distance of 100.00' to an iron pipe found; thence North 51 deg. 36' 58" East, a distance of 86.98' to an iron pipe found; thence South 27 deg. 58' 40" East, a distance of 90.02' back to the true place of beginning. Having found to contain 0.3059 acres of land, as surveyed by Terrence L. Pearson R.P.S. 7305 on February 10, 1997, but excepting all highways, easements and restrictions of record.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 3837 Martha Road, Kent, OH 44240.

Said Premises Appraised at $150,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
