In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, January 8, 2018, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, January 22, 2018 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Ravenna to-wit:

 

Situated in the County of Portage, in the State of Ohio and in the Township of Ravenna:

And known as being part of Original Ravenna Township Lot No. 8 of the North Division of Lots and is further described as follows:

Beginning at a railroad spike found in the centerline of Peck Road CH 167, 60' wide, at its intersection with the centerline of Lake Rockwell Road, CH 154 60' wide; said railroad spike is also on the dividing line between Ravenna Township and Shalersville Twp.; thence along the centerline of Lake Rockwell Road, lot line and township line, S. 89 deg. 54' 43" W., a distance of 444.86 feet to a point at the Northeast corner of lands now or formerly owned by January Development (178/602) which is the true place of beginning for this parcel of land; thence along the Easterly line of said January Developments S. 00 deg. 05' 17" E. a distance of 736.98 feet to an iron rod found in the Northerly line of lands now or formerly owned by R. M. or J. A. Reese (182/487) and passing over an iron rod found at a distance of 30.00 feet; thence along the Northerly line of the said R. M. or J. A. Reese N. 89 deg. 51' 10" W., a distance of 250.00 feet to an iron rod set; thence N. 00 deg. 05' 17", a distance of 735.95 feet to a point in the centerline of Lake Rockwell Road and Northerly line of said Lot 5N and said township line and passing over an iron rod set a distance of 30.00 feet from said point; thence along the centerline of Lake Rockwell Road, lot line and township line N. 89 deg. 54' 43" E., a distance of 250.00 feet to the true place of beginning and containing a total of 4.227 acres of land, be the same more or less as surveyed and described in September 1997 by Dan Trocchio, Registered Surveyor No. 6445, be the same more or less, but subject to all legal highways.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 4948 Lake Rockwell Road, Ravenna, OH 44266.

Said Premises Appraised at $250,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
