In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, April 20, 2020, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, May 4, 2020 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

Situated in the Township of Brimfield, County of Portage and State of Ohio:

And known as being part of Lot 42 in said township, further bounded and described as follows:

Beginning at a 3/4 inch pipe found 3 inches high marking the Southeast corner of Lot 42; thence North 00 deg. 28' 00" West, along the East line of Lot 42, a distance of 1,000.41 feet to a 5/8 inch pipe found 1 inch deep in the centerline of Ranfield Road, C.H. 88-F, 60 feet wide; thence North 72 deg. 54' 16" West, along the centerline of Ranfield Road, a distance of 62.93 feet to a track spike set and the true place of beginning of land herein to be described; thence South 00 deg. 28' 00" East, thru the Grantors land, passing over a 5/8 inch rebar with I.D. Cap No. 6541 set 2 inches high, at 31.47 feet from centerline, a total distance of 379.58 feet to a 5/8 inch rebar with I.D. Cap No. 6541 set 2 inches high; thence North 89 deg. 12' 00" West, a distance of 307.35 feet to a 5/8 inch rebar with I.D. Cap No. 6541 set 2 inches high on the East line of land conveyed to the German Family Society of Akron, Inc., by Instrument recorded in D.B. Volume 958, Page 789; thence North 00 deg. 32' 37" West, along the East line of land conveyed to the German Family Society of Akron, Inc., passing over a 1/2 inch pipe found flush at 438.76 feet, a total distance of 470.24 feet to a point in the centerline of Ranfield Road (witness a 1/2 inch pipe found 9 inches deep, North 72 deg. 54' 16" West, a distance of 28.00 feet from point described); thence South 72 deg. 54' 16" East, along the centerline of Ranfield Road, a distance of 322.96 feet to the place of beginning and containing 3.000 acres of land, be the same more or less, but subject to all legal highways. Rights and easements of record, as surveyed in July, 1988 by John W. Patrick, Jr., Professional Land Surveyor No. 6541. The bearing of North 00 deg. 28' 00" West, along the East line of Lot 42, as described in Deed Book Volume 709, Page 486 was used as the "Basis of Bearings" for this survey and legal description, be the same more or less, but subject to all legal highways.

Said Premises Appraised at $120,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
