In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, June 3, 2019, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, June 24, 2019 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate is

 

Situated in the Township of Rootstown, County of Portage and State of Ohio:

Being part of Lot 14 and 15 in the said township and is further described as follows:

Beginning at a point in the centerline of Cook Road C.H. 107 with the intersection of the South line of Lot 15; thence along the centerline of Cook Road N. 49 deg. 20' 36" W., a distance of 173.01 feet to an iron pipe found which is the true place of beginning for this parcel of land; thence S. 40 deg. 39' 24" W., a distance of 259.69 feet to an iron pipe found in the Northwesterly line of lands now or formerly owned by A. & M. Hartville and passing over an iron rod found at a distance of 30.0 feet; thence S. 89 deg. 42' 45" W., a distance of 886.34 feet to an iron rod found at the Northwest corner of lands now or formerly owned by A. Hartville, et al.; thence N. 00 deg. 08' 54" E., a distance of 82.50 feet to an iron pipe found at the Southwest corner of Lot 15; thence along the West line of Lot 15 N. 01 deg. 18' 29" W., a distance of 169.82 feet to an iron rod found at the Southwest corner of lands now or formerly owned by Mary J. Spellman; thence along the South line of M. J. Spellman S. 89 deg. 12' 15" E., a distance of 589.17 feet to an iron pipe set; thence S. 00 deg. 17' 55" E., a distance of 191.14 feet to an iron pipe set; thence N. 89 deg. 42' 45" E., a distance of 276.86 feet to an iron pipe found; thence N. 40 deg. 39' 24" E., a distance of 236.87' to a point in the centerline of Cook Road and passing over an iron pipe found at a distance of 30.0 feet from said point; thence along the centerline of Cook Road S. 49 deg. 20' 36" E., a distance of 50.0 feet to the true place of beginning and containing a total of 3.941 acres of land, there being about 1.530 acres in Lot 14 and about 2.411 acres in Lot 15, be the same more or less, but subject to all legal highways as surveyed December 1982, by Don Trocchio, Registered Surveyor No. 6445.

Said Premises Located at 3607 Cook Road, Rootstown, OH 44272.

Said Premises Appraised at $150,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
