In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, June 26, 2017, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, July 10, 2017 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Ravenna to-wit:

PARCEL NO. 1:

Situated in the Township and City of Ravenna, County of Portage and State of Ohio:

PARCEL "A":

And being part of Lot 15 South Division in said township and city and bounded and described as follows:

Beginning at a monument at the intersection of the centerline of Day Street and Lincoln Avenue; thence S. 83 deg. 38' 08" W., along the centerline of Lincoln Avenue, a distance of 419.54 feet to a point at the Northwesterly corner of land now or formerly owned by H. & J. Triplett which marks the true place of beginning for the following described parcel of land:

Thence S. 02 deg. 30' 43" W., along the Westerly line of said Triplett (passing over an iron pipe at 27.35 feet), a distance of 514.33 feet to an iron pipe in the Southerly line of said Lot 15; thence N. 06 deg. 52' 53" W., along the Southerly line of Lot 15, a distance of 19.65 feet to an iron pipe; thence N. 02 deg. 30' 43" E., (passing over an iron pipe at 483.00 feet), a distance of 511.03 feet to a point in the centerline of Lincoln Avenue; thence N. 83 deg. 38' 08" E., along the centerline of Lincoln Avenue, a distance of 20.00 feet to the true place of beginning, containing 0.232 acres of land, more or less, as surveyed February 3, 1973, by Albert Szuch, Registered Surveyor No. 5398.

Known as being part of South Division Lot 15 and being bounded and described as follows:

Beginning at a point in the center of Lincoln Avenue 41.02 feet Southwesterly from the Northwest corner of land of Doris C. Morton; thence S. 2 deg. 30' W., 531.29 feet to the South line of Lot 15; thence N. 37 deg. 30' W., 62.09 feet; thence N. 2 deg. 30' E., 526.02 feet to the center of Lincoln Avenue; thence Northwesterly 62.31 feet to the place of beginning. Containing 0.75 acre.

PARCEL NO. 3:

Situated in the City of Ravenna, County of Portage and State of Ohio:

And known as being part of Lot No. Fifteen of the South Division of Lots in Ravenna Township, bounded as follows:

Beginning in the center of Lincoln Avenue at the Northwest corner of land in said lot owned by Doris C. Morton, and more recently owned by the First Savings Bank and Trust Co. of Ravenna, Ohio; thence South 2 deg. 30' West along the West line of said land so owned by Doris C. Morton, 8 chains, 10 1/6 links to the South line of said township lot; thence N. 87 deg. 30' West along said South line of said township lot 40.74 feet; thence North 2 deg. 30' East about 7 chains, 97 links to a point in the centerline of Lincoln Avenue, such point being about 60 feet West of the place of beginning; thence East along said centerline a distance of about 60 feet to the place of beginning. Said lot fronting about 60 feet on Lincoln Avenue and the back or South side of said lot being 40.74 feet and containing 1/2 acre of land.

Said Premises Appraised at $85,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
