The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Nelson to-wit:
Situated in the Township of Nelson, County of Portage and State of Ohio and known as being part of Lot 35 in said township and further bounded and described as follows:
Beginning at a point on the centerline of Garrettsville Parkman Road (State Route 282, said point being South 19 degrees 00' 10" East, a distance of 584.13 feet from a bridge spike found at the centerline intersection of said Garrettsville Parkman Road and Kennedy Ledge Road; thence North 77 degrees 00' 00" East, and passing over and iron pin set at 30.16 feet, a distance of 511.38 feet to an iron pin set on the West line of land conveyed to L. Dolgan by Deed 009627841; thence South 1 degree 43' 54" East, along said West line of Dolgan's land, a distance of 482.64 feet to an 1/2" iron pipe found on the North line of land conveyed to K. and L. Janecek's by deed recorded in Volume 31, Page 275 of Portage County Official Records; thence North 89 degrees 39' 57" West, along said North line of Janecek's lands, a distance of 547.50 feet to a 1" square iron pin found on the centerline of said Garrettsville Parkman Road; thence North 5 degrees 22' 31" West, along said road centerline, a distance of 218.30 feet to a point; thence North 19 degrees 00' 10" West, continuing along said road centerline, a distance of 131.41 feet to a point and the true place of beginning and containing therein 5.3909 acres of land (of which 0.2433 acres are within the road right-of-way) as surveyed in April 2002, by Jerry W. Daniel, Registered Surveyor No. 6222.
The sheriff's office nor any affiliate have access to the inside of said property.
Said Premises Located at 12094 State Route 282, Garrettsville, OH 44231.
Said Premises Appraised at $115,000.00 and cannot be sold for less than two-thirds of that amount.
TERMS OF SALE: CASHIER CHECKS ONLY
If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)
Deposit required by Third Party Purchasers are as follows:
If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).
Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).
Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)
The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)
The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.
The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
