In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, December 31, 2018, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, January 14, 2019 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Freedom to-wit:

 

"The real estate subject to this foreclosure action consists of 63 acres of vacant land on Nichols Road (a North/South road East of the real estate). The intersection to the South of the real estate is State Route 88 (a North/South road). The intersection to the North of the real estate Interstate 80 (an East/West road)."

"If the property does not receive sufficient bid on the first sale date, and is set for a second sale date with no minimum bid, the purchaser shall be responsible for those costs, allowances, and real estate taxes that the proceeds of the sale are insufficient to cover pursuant to Ohio Revised Code, Section 2329.21."

Situated in the Township of Freedom, County of Portage and State of Ohio and being known as part of Lot 45 in said township and further bounded and described as follows:

Beginning at a point on the centerline of Nichols Road (CH 225, 60 foot R/W) at the Northeast corner of lands conveyed to J. Goodmote by Portage County Instrument No. 200918100, said point being North 0 deg. 08' 06" East, 754.04 feet from a 1 inch iron pin found in a monument box at the centerline intersection of said Nichols Road and Hudson Braceville Road (SR 303), also being the Southeast corner of said Lot 45; thence North 88 deg. 56' 50" West along the North line of said Goodmote and passing over a 1/2 inch iron pipe found at 30.13 feet and passing along the North line of the following five land title holders and their respective deed numbers:

1) M & V Paul, 201217923, 2) B Fagen, 200114140, 3) J or B Sizemore, OR 238/546, 4) H Mack, 1122/553 and 5) T or J Cummings, OR 332/99, a distance of 2814.27 feet to a point (witnessed by a 5/8 inch capped "Daniel" iron pin found 0.28 feet South) and the Northwest corner of said Cumming's lands and on the East line of lands conveyed to C & J Howald by Volume 1168, Page 649 of the Portage County Records of Deeds; thence North 0 deg. 13' 40" West, along the East line of said Howald, a distance of 473.15 feet to a 5/8 inch capped "McGuire" found at the Northeast corner thereof; thence North 88 deg. 53' 32" West, along the North line of said Howald, a distance of 139.15 feet to a 5/8 inch capped "McGuire" rebar found on the West line of said Lot 46; thence North 0 deg. 52' 54" West, along said lot line, a distance of 1141.82 feet to a 5/8 inch capped "K&S" iron pin found on the South line of lands of the Ohio Turnpike Commission; thence South 85 deg. 46' 24" East, along said South line of the Ohio Turnpike, a distance of 1391.03 feet to a 5/8 inch capped rebar set; thence South 22 deg. 38' 33" East, along a new line, a distance of 1515.07 feet to a 5/8 inch capped rebar set; thence South 88 deg. 56' 50" East, along a new line and passing over a 5/8 inch capped rebar set at 972.39 feet, a distance of 1002.39 feet to a point on said road centerline and lot line; thence South 0 deg. 08' 06" West, along said road centerline and lot line, a distance of 150.00 feet to the point of beginning and containing 63.000 acres of land of which 0.133 acres lie within the road right of way as surveyed in December, 2013 by Clifford H. McGuire, Professional Surveyor No. 7770. The basis of bearing was taken from Survey Plat P-16603. Deed of record was Instrument No. 201110520 to Waginacci Partnership.

Said Premises Located at Vacant Land/Frontage on Nichols Rd., Freedom Twp., Windham, OH

Said Premises Appraised at $126,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Creditor is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
