In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, December 17, 2018, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, December 31, 2018 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

 

And known as being part of Lot 18 in Rootstown Township and further described as follows:

Beginning at a point in the centerline of Sandy Lake Road and the South line of Lot 18 and being N. 89 degrees 22' 20" West, 636.76 feet from an iron bar at the Southeast corner of Lot 18; thence N. 89 degrees 22' 20" West, 150.00 feet along the centerline of Sandy Lake Road and the South line of Lot 18 to the Southeast corner of E. and N. Phile; thence N. 0 degrees 37' 40" East, 264.00 feet to an iron pipe at Phile's Northeast corner and passing over an iron pipe 30 feet from the road center; thence N. 89 degrees 22' 20" W., 165.00 feet to an iron pipe at Phile's Northwest corner; thence N. 0 degrees 37' 40" East, 221.00 feet to an iron pipe; thence S. 89 degrees 22' 20" East, 315.00 feet; thence S. 0 degrees 37' 40" West, 485.00 feet to the beginning, and passing over an iron pipe 30 feet from the road center; thence S. 89 degrees 22' 20" East, 315.00 feet to an iron pipe, be the same more or less. Being all and the same lands and premises conveyed to Daniel Yinkey and Tracey D. Yinkey, husband and wife, for their joint lives, remainder to the survivor of them by John L. Klinger, Jr. and Joan A. Klinger in a Survivorship Deed executed 7/8/1997 and recorded 7/18/1997 in Book 0215, Page 364 of the Portage County, Ohio lands recorded 12/21/2009.

Said Premises Appraised at $170,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
