In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, December 3, 2018, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, December 17, 2018 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated

 

Situated in the Township of Mantua, County of Portage, State of Ohio, being part of Lot 13 in said township and bounded and described as follows:

Beginning at a point in the West line of Mantua Township, at the intersection of the Northwest corner of Lot 13 and centerline of T.H. 258 Townline Road; thence South 00 deg. 47' 00" W., along the West line of Mantua Township, West line of Lot 13 and centerline of T.H. 258, a distance of 2368.66 feet to a point at the Southwest corner of land now or formerly owned by G. T. Jr. or C. M. Link (Vol. 985, Pg. 363), which marks the true place of beginning for the following described parcel of land; thence S. 89 deg. 07' 44" E., along the South line of said link (passing over a 1/2" iron pipe found at 30.00 feet) a distance of 2365.90 feet to a 1/2" iron pipe found of the West line of Olde Taylor Woods as recorded in Plat 98-74 of the Portage County Record of Plats; thence S. 00 deg. 39' 10" W., along the West line of Olde Taylor Woods, a distance of 100.16 feet to a 3/4" iron pipe found at the Northeast corner of land now or formerly owned by G. W. or S. A. Johson (Vol. 1024, Pg. 682); thence N. 89 deg. 07' 30" W., along the North line of said Johson (passing over a 3/4" iron pipe found at 2336.35 feet) a distance of 2366.13 feet to a point in the West line of Mantua Township, West line of Lot 13 and centerline of T.H. 258; thence N. 00 deg. 47' 00" E., along the West line of Mantua Township, West line of Lot 13 and centerline of T.H. 258, a distance of 100.00 feet to the true place of beginning, containing 5.4354 acres of land, more or less, as surveyed and described June 3, 2004 by Rob A. Szuch, Registered Professional Surveyor No. 7288. Being the same property as conveyed from William G. Barlow, widowed and not remarried to Carl Frankito and Virginia Frankito, for their joint lives, remainder to the survivor of them, as described in Deed Instrument No. 200417204, dated 6/8/2004, recorded 6/18/2004.

Said Premises Located at 110 Townline Road, Aurora, OH 44202.

Said Premises Appraised at $130,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
