In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, June 4, 2018, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, June 18, 2018 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Deerfield to-wit:

 

Being a parcel of land located in Lot 63, Deerfield Township, Portage County, State of Ohio and being further described as follows:

Commencing at a railroad spike found at the intersection of the centerline of Mahoning Rd. (C.H. 73) and Woodard Rd (C.H. 70); thence South 89 deg. 45" East along the centerline of Woodard Rd. (C.H. 70) and the Northerly line of Lot 63, a total distance of 665.96 feet to a boat spike set on said line, said point being the true place of beginning for this survey; thence continuing South 89 deg. 45' East along the centerline of Woodard Rd. (C.H. 70) and the Northerly line of Lot 63, a total distance of 363.00 feet to a boat spike set on the Northerly line of Lot 63 and the Southerly line of Lot 64; thence South 0 deg. 15' West along a line running through the Grantors property and passing over an iron pin set at 30.00 feet, a total distance of 600.00 feet to an iron pin set; thence North 89 deg. 45' West along a line running through the Grantors property, a total distance of 363.00 feet to an iron pin set; thence North 0 deg. 15' East along a line running through the Grantors property and passing over an iron pin set 30.00 feet from the centerline of Woodard Rd., (C.H. 70) a total distance of 600.00 feet to the true place of beginning for this survey and containing 5.000 acres of land as surveyed in September 1973 by Floyd L. Thomas and Samuel C. Janka, Reg. Surveyors No. 5461 and 5739 of the State of Ohio. Subject to all easements on record. Excepting therefrom the following tract of land:

Being a parcel of land located in Lot 63, Deerfield Township, Portage County, State of Ohio and being further described as follows:

Commencing at a railroad spike found at the intersection of the centerline of Mahoning Road (C.H. 73) and Woodard Road, (C.H. 70); thence South 89 deg. 45' East along the centerline of Woodard Road (C.H. 70) and the Northerly line of Lot 63 a total distance of 665.96 feet to a boat spike on said line; thence South 0 deg. 15' West along the Easterly property line of land now or formerly owned by Clara Bandi, a total distance of 300.00 feet to an iron pin on said line, said point being the true place of beginning for this survey; thence South 89 deg. 45' East along a line running through the Grantors property a total distance of 363.00 feet to an iron pin; thence South 0 deg. 15' West along the Easterly line of the Grantors property a total distance of 300.00 feet to an iron pin set; thence North 89 deg. 45" West along the Southerly line of the Grantors property a total distance of 363.00 feet to an iron pin; thence North 0 deg. 15' East along the Easterly property line of land now or formerly owned by Clara Bandi; a total distance of 300.00 feet to the true place of beginning for this survey and containing 2.500 acres of land as surveyed in May 1975 by Floyd L. Thomas, Reg. Surveyor No. 5461 of the State of Ohio. Excepting .141 acre as platted in Vacation Plat Volume 31, Page 59 Ordinance No. 84-320 of Portage County Records.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 10720 Woodard Road, Deerfield, OH 44411.

Said Premises Appraised at $60,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
