In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, April 23, 2018, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, May 7, 2018 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Aurora to-wit:

 

Situated in the City of Aurora, County of Portage and State of Ohio:

And known as being part of Original Township Lots Nos. 24 and 31, also the North part of Sublot 12 of Andrew Jackson Estates, Volume 5, Page 49 and more particularly described as follows:

Beginning at an iron pin found in the common line between Great Lots Nos. 24 and 31 of Aurora Township at its intersection with the North line of Sublot No. 12 of Andrew Jackson Estates. This iron pin is situated 2,004.00 feet North of the Southeast corner of Great Lot No. 24; thence South 67 degrees 52' East along the North line of said Lot No. 12 and center line of Jackson Road for a distance of 70.00 feet to an iron pin; thence South 10 degrees 50' West along the East line of said Lot No. 12 for a distance of 327.11 feet to an iron pin; thence North 68 degrees 31' West for a distance of 539.92 feet to an iron pin in the West line of said Lot No. 12; thence North 11 degrees 47' East along the West line of said Lot No. 12 and center line of Hanes Road for a distance of 269.70 feet to an iron pipe in the Northwest corner of said Lot No. 12; thence South 78 degrees 38' East along the North line of said Lot No. 12 and the center line of Jackson Road for a distance of 329.70 feet to an iron pin in an angle in the center line of Jackson Road; thence South 67 degrees 52' East along the North line of said Lot No. 12 and center line of Jackson Road for a distance of 130.35 feet to the place of beginning, and found to contain 3.765 acres of land as surveyed by Lucius F. Converse, R.S. 1199 in November, 1962 of which 0.240 acres are situated in Lot No. 31 and 3.523 acres are situated in Lot No. 24, being the same more or less. But subject to all legal highways.

Said Premises Appraised at $500,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
