In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, April 23, 2018, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, May 7, 2018 at 11:00 A.M. to the highest bidder.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Garrettsville to-wit:

 

FIRST TRACT:

Situated in the Village of Garrettsville, County of Portage and State of Ohio and bounded and described as follows:

Being a part of Original Lot No. 1 in the Township of Nelson and being known as Village Lot No. 32 in said Village of Garrettsville according to the survey of J. Cole, County, Surveyor, made in 1870 as the same is platted and recorded in the records of said county in Plat Volume 2, Page 7.

SECOND TRACT:

Situated in the Village of Garrettsville, County of Portage and State of Ohio:

And being a part of Village Lot No. 33 in said village and of Original Lot No. 1 of Nelson according to said survey and is bounded and described as follows:

Beginning at the Northwesterly corner of Lot No. 33 on the Southerly line of Center Street; thence Easterly along the line of said street, 20 feet to a stake; thence Southerly at right angles with said street to a point 10 feet Easterly of the Southwesterly corner of said lot and the Southerly line of said lot; thence Westerly on the Southerly line of said lot 10 feet to the Southwest corner of said lot; thence Northerly along the line of said lot to the place of beginning. As shown in J. Cole's Plat Page 2, Page 7 of Portage County Records. But excepting therefrom the following described premises:

FIRST EXCEPTION:

Situated in the Village of Garrettsville, County of Portage and State of Ohio:

Known as being a part of Village Lots No. 32 and 33 of Original Nelson Township Lot No. 1 according to the survey of J. Cole, made in A.D. 1870 and described as follows:

Commencing at an iron pipe set on the rear line of Lot No. 32, which is also the Northeast corner of the Methodist Church lands in Lot No. 38 and running thence North 62 degrees 30' East, 88.25 feet to an iron pipe on the corner of lands in Lot No. 33 heretofore sold to the Board of Education by Wm. B. McConnell as Administrator of the C. O. Foote Estate, which said point is 10 feet Easterly from the Southeast corner of Lot No. 32; thence North 27 degrees 30' West on the line of lands purchased of said C. O. Foote Estate, a distance of 35 feet to a point; thence South 62 degrees 30" West, parallel to the first course herein to the point of intersection of the Easterly line of the Methodist Church property as extended, this being also the West line of lands of the Board of Education purchased from Caroline F. Wolcott et con in 1880; thence South 11 degrees 11' East on said extended property line of the place of beginning and being a strip of land 35 feet in width off the rear of the lands now owned by the Grantors herein, without frontage on any street and containing about 0.008 acres in Lot No. 33 and 0.058 acres in Lot No. 32. According to J. Cole's survey in Plat Book 2, Page 7.

SECOND EXCEPTION:

Being premises sold to Cecil B. and Esther Wagner and bounded and described as follows:

Situated in the Village of Garrettsville, County of Portage and State of Ohio:

And known as part of Original Lot No. 1 in Nelson Township and being parts of Lots 32 and 33 in Garrettsville Village as surveyed by J. Cole A.D. 1870 and more particularly described as follows:

Beginning at a pipe at the Northwest corner of Lot 33 (which is also the Northeast corner of Lot 32; said point being in the Southerly line of Center Street; thence North 61 degrees 04' East, along the Southerly line of said Center Street for a distance of 20.00 feet to an iron pipe in the Northwest corner of land owned now by the Board of Education; thence South 27 degrees 30' East along the Westerly line of said Board of Education lands for a distance of 129.00 feet to an iron pipe; thence South 62 degrees 30' West for a distance of 12.10 feet to a point in the East line of said Lot No. 32; thence continuing South 62 degrees 30' West, for a distance of 47.88 feet to an iron pipe; thence North 27 degrees 30' West, for a distance of 127.50 feet to an iron pipe in the Southerly line of Center Street; thence North 61 degrees 04' East, along the Southerly line of Center Street for a distance of 40.00 feet to the place of beginning and containing 0.177 acres of land, of which 0.047 acres are in Lot 33 and 0.13 acres are in Lot No. 32 and shown as 69 feet in Lot No. 32. As recorded in J. Cole's recorded survey in Plat Book 2, Page 7, Portage County Records.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
