In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, January 22, 2018, at 11:00 A.M.

 

PARCEL 1:

Situated in the Township of Hiram, County of Portage and State of Ohio:

And known as being part of Lot 50 in Hiram Township and further described as follows:

Beginning at a spike in the centerline of Vaughn Road and the West line of Lot 50 and being N. 0 deg. 31' W., 640.20 feet from an iron pipe at the Southwest corner of Lot 50; thence N. 0 deg. 31' W., 369.50 feet along the lot line and centerline of Vaughn Road to a spike at the Grantor's Northwest corner; thence N. 89 deg. 49' 30" E., 967.56 feet to an iron pipe at the Grantor's Northeast corner and passing over an iron pipe 30 feet from the road center; thence S. 0 deg. 31' E., 371.51 feet to an iron pipe at the Northeast corner of Chulainn, Inc.; thence S. 89 deg. 56' 38" W., 967.57 feet along Chulainn, Inc. North line to the beginning and passing over an iron pipe 30 feet from the road center. Containing 8.229 acres of land, be the same more or less, as surveyed in June, 1974 by David J. T. and O. L. Miner; thence S. 10 deg. 6' W. along the West line of said Miner's land 18 chains and 94 links to an erect stone; thence N. 88 deg. 56' W. along the North line of land now or formerly owned by E. J. Braun 14 chains and 76 links to a stake in the West line of said lot; thence Northerly along the lot line 19 chains and 3 links to place of beginning and containing 27.83 acres of land.

Beginning at a marked stone in the center of the road at the Southwest corner of Lot 50 and also of Hiram Township; thence running along the West line of said lot N. 0 deg. 35' East 9 chains and 70 links to a piece of iron gas pipe; thence S. 88 deg. 30' E. parallel with the South line of the lot 14 chains and 66 links to a piece of gas pipe; thence S. 0 deg. 35' West parallel with the West line of said lot, 9 chains and 70 links to the South line of the lot; thence North 88 deg. 30' W. along the South line of the lot, 14 chains and 66 links to the place of beginning and containing 14.23 acres of land.

(C.H. 220); thence North 86 deg. 23' West along the centerline of said Goodell Rd. a distance of 579.26 feet to a railroad spike set; thence North 3 deg. 11' 56" East, a distance of 485.00 feet to an iron pin set passing over an iron pin set at 30.00 feet; thence North 86 deg. 22' 57" West, a distance of 782.29 feet to an iron pin set on the East line of land now or formerly owned by Goodell Farms, an Ohio partnership, as recorded in Deed Volume 984, Page 1189; thence North 3 deg. 38' 16" East along said Goodell Farms East line and the remains of an old barb wire fence a distance of 1711.16 feet to an iron pin set on the North line of Shalersville Township Lot 10 and South line of Mantua Township Lot 42; thence South 85 deg. 52' 54" East along said township's line, a distance of 1348.57 feet to an iron monument box found 1.5 feet deep in the centerline of Vaughn Rd. marking the common corner of Shalersville Twp. Lot 10, Mantua Twp. Lot 42, Hiram Twp. Lot 50 and Freedom Twp. Lot 83 and passing over an iron pipe found a distance of 1318.57 feet; thence South 3 deg. 11' 56" West along the East line of said Shalersville Twp. and West line of Freedom Township and centerline of Vaughn Rd. a distance of 2184.68 feet to the place of beginning and containing 59.494 acres of land, more or less, as surveyed in March 2014 by Peter L. Dunn, Ohio Surveyor No. 8340.

All iron pins set are No. 5 rebar 30" long with cap #8340.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 10272 Vaughn & 5455 Goodell Rd. VL, Mantua, OH 44255.

Said Premises Appraised at $418,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
