In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, April 6, 2020, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, April 20, 2020 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate is

 

Situated in the Township of Edinburg, County of Portage and State of Ohio and known as being part of Original Edinburg Township Lot Nos. 6 N.W. and 7 N.W. and further bounded and described as follows:

Beginning at a p.k. nail set at the intersection of the centerline of Tallmadge Road (County Highway 18) (60 feet wide) and the Easterly line of Original Edinburg Township Lot No. 6 N.W.; thence South 87 deg. 44' 46" West along the centerline of Tallmadge Road, 670.72 feet to a point and the principal place of beginning of the premises herein described; thence South 87 deg. 44' 46" West continuing along the centerline of Tallmadge Road, 302.70 feet to a point; thence North 00 deg. 11' 31" East, passing through a 5/8"x30" iron pin set on the Northerly line of Tallmadge Road at 30.03 feet, 2395.28 feet to a 5/8"x30" iron pin set on the curved Southerly line of Interstate 76 (250 feet wide) as shown by the centerline plat recorded in Volume 17, Page 18B of Portage County Map Records; thence along the curved Southerly line of Interstate 76 deflecting to the left an arc of 334.38 feet, said curve having a radius of 11584.16 feet and a chord that bears South 88 deg. 14' 50" East, 334.36 feet to a 5/8"x30" iron pin set; thence South 00 deg. 11' 31" West, 2144.55 feet to a 5/8"x30" iron pin set; thence South 89 deg. 48' 29" East, 10.56 feet to a 5/8"x30" iron pin set; thence South 00 deg. 11' 31" West, 59.73 feet to a 5/8"x30" iron pin set; thence North 89 deg. 48' 29" West, 42.43 feet to a 5/8"x30" iron pin set; thence South 00 deg. 10' 22" West, passing through a 5/8"x30" iron pin set on the Northerly line of aforesaid Tallmadge Road at 138.94 feet, 168.97 feet to the centerline of Tallmadge Road and the principal place of beginning and containing 18.1748 acres of land, of which 0.2085 acres of land are within the right-of-way of Tallmadge Road, 17.0737 acres of land are within Original Edinburg Township Lot No. 6 N.W. and 1.1011 acres of land are within Original Edinburg Township Lot No. 7 N.W., as surveyed and described by Edward B. Dudley, P.S. No. 6747 of the Riverstone Company in August, 2003, be the same more or less, but subject to all legal highways.

Basis of Bearings: The centerline of Tallmadge Road (County Highways 18) as South 87 deg. 44' 46" West, being the Southerly line of land conveyed to Melissa M. Kibler as recorded in Volume 1012, Page 32 of Portage County Recorder's Office.

Deed of Reference: Deed of land conveyed to Melissa M. Kibler as dated June 13, 2002 and recorded in Volume 1012, Page 32 of Portage County Recorder's Office.

Said Premises Located at 5935 Tallmadge Rd., Rootstown, OH 44272.

Said Premises Appraised at $190,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
