In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, January 13, 2020, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, January 27, 2020 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Ravenna to-wit:

 

Known as being part of Lot 19 in the South Division of lots in Ravenna Township and more fully described as follows:

Beginning at an iron pin found at the Southeast corner of Murray Avenue, and Ideal Steel in Ravenna Building Company's Allotment No. 1; thence N. 89 deg. 44' 36" E., along the South line of Murray Avenue, 62.00 feet to an iron pin; thence S. 1 deg. 06' E., 173.00 feet to an iron pin in the South line of Sublot 11, Block B; thence S. 89 deg. 44' 36" W., parallel to the said line of Murray Avenue and along the South line of Sublot 11, Block B, 62.00 feet to an iron pin in the East line of Ideal Street, now known as Crestwood Drive; thence N. 1 deg. 06' W., along the East line of Ideal Street and known as Crestwood Drive, 173.00 feet to the place of beginning, as surveyed by R. A. Weinkauf, Registered Surveyor No. 3859. Intending to convey parts of Sublots 8, 9, 10 and 11 in Block B, Ravenna Building Company Allotment No. 1 and containing 0.246 acres, as platted, numbered and recorded in Plat Book 4, Page 12, of Portage County Plat Records. Also intending to convey a portion of vacated Crestwood Drive and recorded in Vol. 24, Page 1 of Portage County Records and containing 0.0794 acres. Excepting therefrom:

Situated in the City of Ravenna, County of Portage and State of Ohio:

Situated in the city, county and state aforesaid and known as being a part of vacated Crestwood Drive by City Ordinance No. 1975-67, August 2, 1976 of Ravenna Building Company Allotment as recorded in Volume 4, Page 12 of the Portage County Record of Plats and further described as follows:

Beginning at an I.P. in the SW corner of Lot 11, Block 13 of said allotment; thence N. 87 deg. 30' 18" W., along the South line of said allotment, 14.04' to an I.P. which is the true place of beginning; thence continuing along the South line of said allotment N. 87 deg. 30' 18" W., a distance of 6.00' to an IP marking the centerline of that vacated portion of Crestwood Road; thence N. 03 deg. 54' 05" E., a distance of 172.97' along the Easterly line of A. L. Gray, Trustee and S. D. and R. E. Postlethwaite and the centerline of vacated street to an IP in the South right of way line of Murray Avenue; thence S. 87 deg. 30' 00" E., a distance of 6.00' along the Southerly right of way line of Murray Avenue to an IP; thence S. 03 deg. 54' 05" W., a distance of 172.97' to an IP the true place of beginning and containing 0.024 acres of land more or less and subject to all legal highways and easements of record as surveyed by Edward P. Wanchick, Registered Surveyor No. 5756.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 1158 Murray Avenue, Ravenna, OH 44266.

Said Premises Appraised at $125,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
