In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, October 16, 2017, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, October 30, 2017 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Streetsboro to-wit:

Situated in the County of Portage, in the State of Ohio and in the City of Streetsboro:

And known as being part of Streetsboro Township Lot 57 and further described as follows:

Starting at the intersection of centerline of State Route 14 with the South line of Lot 57; thence N. 35 deg. 44' 20" W., 462.88 feet along the centerline of State Route 14 to a spike at an angle; thence N. 47 deg. 33' 20" W., 1298.67 feet along said road centerline; thence 111.92 feet along the arc of a curve to the left, said curve having a central angle of 2 deg. 14' 18" and a chord bearing N. 48 deg. 40' 29" W., a distance of 111.91 feet, to the true place of beginning. Thence continuing Northwesterly along the centerline of State Route 14, 150.00 feet along the arc of a curve to the left, said curve having a central angle of 3 deg. and a chord bearing N. 51 deg. 17' 38" W., a distance of 149.98 feet; thence N. 36 deg. 23' 11" E., 565.13 feet to an iron pipe in the South line of W. & R. Risman and passing over an iron pipe 65 feet from the road center; thence S. 47 deg. 33' 20" E., 209.31 feet along Risman's South line to an iron pipe; thence S. 42 deg. 26' 40" W., 552.19 feet to the true place of beginning and passing over an iron pipe 53 feet from the road center. Containing 2.298 acres of land, be the same more or less, but subject to all legal highways as surveyed in April 1976 by David J. Collier, Registered Surveyor No. 4819.

Starting at the intersection of the centerline of State Route 14 with the South line of Lot 57; thence N. 35 deg. 44' 20" W., 462.88 feet to a pike at an angle; thence N. 47 deg. 33' 20" W., 1110.59 feet along the centerline of State Route 14 to the true place of beginning. Thence continuing Northwesterly along the centerline of State Route 14, N. 47 deg. 33' 20" W., 188.08 feet; thence continuing Northwesterly along the centerline of State Route 14, 11.92 feet along the arc of a curve to the left, said curve having a central angle of 2 deg. 14' 18" and a chord bearing N. 48 deg. 40' 28" W., a distance of 111.91 feet; thence N. 42 deg. 26' 40" E., 552.19 feet to an iron pipe in the South line of W. & R. Risman and passing over an iron pipe 53 feet from the road center; thence S. 47 deg. 33' 20" E., 299.96 feet along Risman's South line to an iron pipe; thence S. 42 deg. 26' 40" W., 550.00 feet to the true place of beginning and passing over an iron pipe 33 feet from the road center. Said Premises Appraised at $500,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
