In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, October 30, 2017, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, November 13, 2017 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Kent to-wit:

Situated in the City of Kent, County of Portage and State of Ohio:

And known as being Block "A" in John J. McKinney Allotment, as recorded in Volume 12, Page 46, Portage County Records of Plats

PARCEL II:

Situated in the City of Kent, County of Portage and State of Ohio:

And known as being a part of Township Lot No. 43, Sublot No. 37 and described as follows:

Beginning at the Southeast corner of Lot 37, in the J. J. McKinney Allotment in Franklin Township, Lot 43, Portage County, Ohio, which is also the existing common corner between Lot 37 and J. M. Vasil and M. F. Vasil; thence S. 89 deg. 17' W., 12.66 feet along the South line of Lot 37; thence N. 0 deg. 43' W., 42.37 feet; thence S. 15 deg. 22' 55" E., 50.00 feet to the beginning and containing 0.01 acres of land as surveyed by Herbert V. Wands, Reg. Surv. No. 3347, Jan. 25, 1958.

Situated in the City of Kent, County of Portage and State of Ohio:

And being a part of Township Lot No. 43 and bounded and described as follows:

Beginning at the Northeast corner of Sol-Acres Allotment in said township lot, and at the center of the road; thence Westerly along the North line of Sol-Acres 200 feet to an iron pipe; thence Northwesterly parallel to the road 100.00 feet to an iron pipe; thence Eastward parallel to the North line of Sol-Acres 200 feet to the center of the road and passing over a pipe at the side; thence South Eastward 100 feet to the place of beginning and containing 0.44 acres of land. Subject to all legal highways. Surveyed Dec. 24, 1954 by Herbert V. Wands, Reg. Surveyor No. 3347.

Excepting therefrom the following described premises:

McKinney Allotment in Franklin Township Lot 43, Portage County, Ohio; thence S. 89 deg. 17' W., 12.66 feet to the true place of beginning; thence S. 0 deg. 43' E., 42.37 feet; thence N. 15 deg. 22' 55" W., 50.00 feet; thence N. 89 deg. 17' E., 12.66 feet to the true place of beginning and containing 0.01 acres of land as surveyed by Herbert V. Wands, Reg. Surveyor No. 3347., January 25, 1958. Be the same more or less, but subject to all legal highways.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 1144 Hudson Road, Kent, OH 44240.

Said Premises Appraised at $120,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
