In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, April 22, 2019, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, May 6, 2019 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate

 

Situated in the State of Ohio, County of Portage, Township of Edinburg and being part of Lot 5 Southeast, Subdivision 3 and being all of parcels now or formerly owned by John C. Epling and Sandra M. Filipczak (Instrument #200410402 and Instrument #200410401) and being more particularly described as follows:

Beginning at a 1/2" rod found at the Southeast corner of said Lot 5, Southeast, Subdivision 3 and the centerline intersection of Porter Road (40 feet wide) and Giddings Road (40 feet wide); thence N. 00 deg. 38' 20" W., along the East line of said Lot S, Southeast Subdivision 3 and the centerline of said Porter Road, a distance of 167.21 feet to a point and the true place of beginning of the herein described parcel:

1. Thence N. 87 deg. 31' 40" W., along lands now or formerly owned by David L. Warrington (Volume 1022, Page 537), a distance of 583.79 feet (and passing over a 3/4" pipe found at a distance of 20.26 feet, a 5/8" steel rod with Deibel cap found at a distance of 404.00 feet and a 3/4" pipe found at a distance of 583.09 feet) to a point;

2. Thence N. 43 deg. 44' 03" W., along the centerline of State Route 14 (variable width), a distance of 149.85 feet to a point;

3. Thence N. 45 deg. 18' 37" E., along lands now or formerly owned by Stephen W. and Vicki C. Hagenbaugh (Instrument 11200116249), a distance of 149.11 feet (and passing over a 5/8" rod with Szuch cap found at a distance of 50.00 feet) to a 5/8" rod with Szuch cap found;

4. Thence N. 0 deg. 044' 06" E. continuing along said Hagenbaugh lands, a distance of 151.80 feet to a 5/8" rod with Szuch cap found;

5. Thence S. 88 deg. 02' 37" E., along lands now or formerly owned by Ronald K. and Julie M. Fisher, Trustee (Instrument #200116263), a distance of 168.62 feet to a 5/8" steel rod with Deibel cap found;

6. Thence S. 00 deg. 38' 20" E., along lands now or formerly owned by John F. and Sara L. McDonald (Instrument #200509105), a distance of 170.50 feet to a 5/8" steel rod with Deibel cap found;

7. Thence S. 88 deg. 02' 37" E., continuing along said McDonald lands, a distance of 403.82 feet (and passing over a 5/8" steel rod with Deibel cap found at a distance of 403.80 feet to a point;

8. Thence S. 00 deg. 38' 20" E., along the East line of said Lot 5, Southeast, Subdivision 3 and the centerline of said Porter Road, a distance of 200.03 fuel to a point and the true place of beginning of the herein described parcel.

The above described parcel contains 3.562 acres, of which 1.836 acres lie within lands conveyed in Instrument #200410401, 0.092 acre lie within the right-of-way of Porter Road and 0.156 acre lie within the right-of-way of State Route 14, as surveyed under the supervision of Curtis G. Deibel, P.S. #6673, in October, 2006. The bearings are based on N. 00 deg. 38' 20" W., for the centerline of Porter Road as shown on a survey by Rob Szuch dated May 10, 2001.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 3410 SR 14, Rootstown, OH 44272.

Said Premises Appraised at $90,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
